Terms of service
Our role as a marketplace, creator responsibilities, payments, and refunds.
Our role
Buy My Agent is operated by BUYMYAGENT TECHNOLOGIES INC., a Canadian corporation (“we”, “us”). Buy My Agent is a curated marketplace and access layer. We provide discovery, branded pages, access control, and payment facilitation through Stripe. We are not the creator, operator, employer, partner, professional adviser, or guarantor of any agent merely because we list it.
Eligibility & your account
You must be at least the age of majority where you live (and at least 18) and able to form a binding contract. You're responsible for the accuracy of your account information, for keeping your login secure, and for activity under your account. The marketplace is currently offered only where the payment jurisdiction is Canada or the United States; it is not directed to the EEA, the United Kingdom, or Switzerland. You may not use the service in violation of export-control or sanctions laws, and you represent that you are not located in an embargoed jurisdiction or on a government restricted-party or sanctions list.
What “agent” means in these Terms
In these Terms and our other policies, “agent”, “AI agent”, and “workflow” are used interchangeably and mean any AI-powered product or service listed on the marketplace, whatever its form — including an interactive or autonomous agent, a workflow or automation, a template or prompt pack, a setup guide, or an integration — together with its prompts, configurations, instructions, documentation, and access method. These are new and evolving terms; these Terms and our policies apply to what is actually listed and supplied, regardless of the label used for it.
No agency or professional relationship
Listing an agent does not make us its provider. Agents produce AI-generated output and are not a substitute for licensed medical, legal, financial, or other regulated professional advice. Use agent output at your own discretion.
Creator responsibility & indemnity
Creators are responsible for their agent, its claims and outputs, external tools and links, data practices, legality, taxes, refunds within policy, and compliance with payment-provider rules, and agree to indemnify the platform for losses arising from their agent or breach of these terms, to the extent permitted by law.
Creators
Creators accept a separate Creator Agreement, which governs fees, payouts, refunds, chargebacks, taxes, data handling, and creator responsibilities in detail. The summary below is part of these Terms; the Creator Agreement controls on creator-specific matters.
Creators are independent suppliers. You create, own, and supply your agent, and you are the supplier of your sale — whether it is sold as a subscription or as a one-time purchase — unless a specific transaction states otherwise. You are responsible for your listing, the agent's functionality and lawful operation, your customer-facing claims, and your compliance with the terms of any third-party AI provider your agent relies on — including not reselling access to a consumer account, a shared login, or a personal subscription, and not claiming affiliation with a provider (see Acceptable Use). You warrant that you hold the rights and permissions necessary to offer your agent, and you indemnify the platform, to the extent permitted by law, against claims arising from your violation of a provider's terms, intellectual-property infringement, or unlawful content. We provide the marketplace infrastructure — discovery, branded pages, access control, and payment facilitation — and earn a 10% marketplace fee, plus any applicable taxes on that fee. We do not guarantee the accuracy, safety, availability, or continued operation of any agent, and we may moderate, suspend, or remove listings under our policies.
External agents & user content
Agents and their tools live on third-party sites we don't control. Reviews and reports are user content subject to our policies and may be moderated or removed.
Marketplace data & insights
Creators retain ownership of their agents and original listing content. Buy My Agent may collect and use listing, transaction and marketplace-performance metadata to operate, secure, measure and improve the marketplace, subject to applicable law and our Privacy Policy. Buy My Agent may create compiled statistics, analyses, benchmarks, reports and other insights derived from marketplace activity, and owns those compiled and derived materials — excluding creator-owned content, personal information and confidential source material. We may publish, license or sell aggregated or de-identified marketplace insights, provided those insights are not designed to identify a creator, subscriber or account and do not disclose exact creator-level financial information. We will not sell personal information, subscriber contact information, private agent-access links, agent source material, private prompts or customer conversations. A creator's own performance data is included in commercial insight products only with their separate, withdrawable opt-in.
Moderation & termination
Every agent undergoes a limited eligibility review before listing, which is not an endorsement or guarantee. We may approve, reject, restrict, unlist, suspend, remove, or permanently ban an agent or account, and may act immediately on high-risk cases. A basic appeal path is available. How paid listings are sold
A paid listing is sold in one of two ways, shown on the listing and again at checkout before you pay:
- Subscription — a recurring monthly or annual charge that renews automatically until you cancel; access continues while the subscription is active. A creator may offer a subscription only where subscribers receive genuine ongoing value (for example updates, support, hosting, maintenance, a community, or API usage), which the listing must state.
- One-time purchase — a single charge. Nothing renews, there are no further charges, and there is nothing to cancel; access is saved to your account and is not limited to a billing period. It buys the listing as supplied, not a promise of future updates or continued availability unless the listing says so.
A free listing costs nothing and must be genuinely usable at no charge. Both kinds of paid sale are made by the creator as merchant of record, and both carry the same 10% marketplace fee to the creator — the fee is never added to what you pay.
Payments
Payments and payouts run through Stripe Connect. The creator is the intended merchant of record; the platform takes an application fee of 10% on each sale — the same on a one-time purchase as on each subscription charge, including every renewal — plus any applicable taxes on that fee. Prices and payouts are in Canadian dollars (CAD). Creators are responsible for applicable taxes on their own sales. Refunds, disputes, and fees are handled in line with Stripe's terms and the Refunds section below.
Refunds
Refunds and cancellations are governed by our standalone Refund & Cancellation Policy, which covers both subscriptions and one-time purchases. The summary below is part of these Terms.
Subscriptions are monthly or annual and cancel anytime — you keep access through the period you already paid for (a canceled annual plan runs to the end of the prepaid year), and that final period is not pro-rated. A one-time purchase has nothing to cancel; a full refund of a one-time purchase ends the access it granted, while a partial refund leaves your access in place. Filing a chargeback may suspend your access while the dispute is investigated, and access ends if the dispute is resolved in your favour and the money is returned to you. Because creators are independent suppliers and the merchant of record, refund decisions rest with the creator; the Platform can facilitate a refund through Stripe at the creator's direction.
To request a refund, use the Contact the creator button on the agent's page or your account — your message is relayed privately to the creator, who replies to your email. Please allow the creator up to 5 business days to respond. If the creator doesn't respond within that window, or access was never delivered, the agent has been unavailable for an extended period, or the listing materially misrepresented what you received, contact us through our contact page and we'll help make it right — including facilitating a refund through Stripe where warranted.
Some charges are refunded automatically, with no action needed from you: if a payment can't be completed — for example your card's billing country isn't one we currently support, or a checkout fails a security check — any amount charged is automatically refunded. Refunds can take a few business days to appear on your statement.
Warranty & liability
The service is provided "as is" and "as available," without warranties of any kind. A listing is the result of a limited eligibility review and is not an endorsement, certification, or guarantee of an agent's safety, accuracy, legality, performance, or suitability. To the maximum extent permitted by law, our total aggregate liability for any claim arising from the service is limited to the greater of (a) the platform fees we earned on your transactions in the 12 months before the claim, or (b) CA$100. This cap and the disclaimers above do not apply to liability that cannot be limited or excluded by law — including fraud, willful misconduct, or gross negligence. Nothing in these Terms limits or excludes any liability, warranty, remedy, cancellation right, refund right, or other right that cannot be limited or excluded under applicable law, including non-waivable consumer-protection rights in your location. Governing law: British Columbia, Canada, without limiting mandatory local rights that apply to you.
Curated advisory services
Curated is a paid advisory service that we — BUYMYAGENT TECHNOLOGIES INC. — provide directly, separate from the marketplace. Unlike a marketplace listing, where we are only the infrastructure between you and an independent creator, for Curated we are the service provider, and this section governs that engagement. If you purchase Curated, you agree to these Curated terms.
Scope and tiers. Curated is offered in three tiers, at the prices shown on our Curated page, plus applicable tax: Discovery — a focused thirty-minute review of your business and the clearest next step; Strategy — a complete assessment and a written AI roadmap of the workflows worth implementing; and Implementation — everything in Strategy, followed by coordination with creators, setup, and support through go-live. Each tier is a fixed one-time price as shown on the Curated page. The specific deliverables and timing of any engagement are what we confirm with you in writing before it begins. Curated is advisory and coordination work; it does not include building, hosting, or operating software for you unless a written engagement says so.
Booking, cancellation & rescheduling. Submitting the Curated form is a request, not a booking, and does not charge you — we confirm timing and send payment details before the session, and a session or engagement is booked once payment is arranged. You may reschedule or cancel a scheduled session by giving us at least 24 hours' notice before the scheduled time, and we'll work with you to find a new time. If you cancel with less than 24 hours' notice or do not attend a scheduled session, we may treat that session as delivered. If we need to reschedule and cannot deliver a session you have paid for, you may reschedule it or receive a refund for that session.
Refunds. Because Curated is a personalized advisory service, fees for a session or deliverable that has already been provided are non-refundable, except where a refund is required by applicable law or we agree otherwise in writing. Before a session or deliverable is provided you may cancel it for a full refund of amounts paid for it; for an Implementation engagement already under way, we may retain a reasonable amount for work performed to date. This does not limit any non-waivable refund or consumer-protection right you have under applicable law.
Third-party software & costs. Acting on our recommendations often requires third-party tools, subscriptions, API usage, or other services — for example an AI provider, a marketplace listing, or other software. Those costs are separate and are your responsibility: our Curated fees do not include them, and third-party products are governed by their own terms and pricing. When a recommendation is one of our marketplace listings, we earn our standard 10% marketplace fee on it; when the right tool is not available through Buy My Agent, we'll recommend it anyway, and we do not take commissions from third-party providers for recommending them.
No guarantee of outcomes or ROI. Curated gives you our honest assessment and recommendations. It is not a guarantee of any particular result, revenue, saving, return on investment, or other business outcome, and it is not legal, financial, tax, accounting, or other regulated professional advice. Outcomes depend on many factors outside our control, including your own execution and the third-party tools you choose to use. Recommendations are framed honestly and are never guaranteed.
Your responsibilities. You are responsible for giving us accurate and complete information, for having the authority to engage us on behalf of your business, and for your own decisions about whether and how to act on our recommendations. You remain responsible for your own systems, data, backups, accounts, and credentials, and for your compliance with the laws and regulations that apply to your business. Evaluate any recommendation for your own circumstances before relying on it.
Liability for Curated. Curated is provided with reasonable care and skill but otherwise "as is," without other warranties. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to a Curated engagement is limited to the fees you paid us for that engagement — this limit applies to Curated in place of the general cap in “Warranty & liability” above. It does not apply to liability that cannot be limited or excluded by law — including fraud, willful misconduct, or gross negligence — and nothing in this section limits or excludes any right or remedy that cannot be waived under applicable law.
Copyright & DMCA
We respond to notices of claimed copyright infringement. If you believe content here infringes your copyright, send a notice through our contact page including the information required by the U.S. Digital Millennium Copyright Act: identification of the work and of the material claimed to infringe, your contact information, a good-faith statement, a statement under penalty of perjury that you are authorized to act, and your signature. We will remove or disable material that is the subject of a valid notice, forward counter-notifications where appropriate, and terminate repeat infringers. Creators must hold all rights necessary for their listings (see the Creator Agreement).
Dispute resolution & governing law
Talk to us first. Before starting any formal proceeding, please contact us through our contact page and give us 30 days to resolve the issue.
United States residents. Except for claims that qualify for small-claims court, you and Buy My Agent agree that any dispute not resolved informally will be settled by binding individual arbitration, and you and we each waive the right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by notifying us through our contact page within 30 days of first accepting these Terms; opting out does not affect the rest of these Terms. This provision does not apply where it is prohibited by law.
Everyone else / where arbitration does not apply. These Terms are governed by the laws of British Columbia, Canada, and the courts of British Columbia have jurisdiction — in each case without limiting any mandatory consumer-protection right, remedy, or venue that applies to you where you live.
Changes, notices & electronic communications
We may update these Terms and our policies. For material changes we'll take reasonable steps to notify you — for example by email or an in-product notice — and update the effective date; if you keep using the service after a change takes effect, you accept the updated version. You agree to receive agreements, notices, disclosures, and other communications from us electronically, and that electronic delivery meets any legal requirement that a communication be in writing. We give you notice at your account email; you give us notice through our contact page or the registered address of BUYMYAGENT TECHNOLOGIES INC.
General
These Terms and the policies they reference are the entire agreement between you and us about the service and supersede prior agreements on that subject. If any provision is unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Nothing here creates an employment, agency, partnership, or joint-venture relationship between you and us, or between a subscriber and a creator. We're not liable for delays or failures caused by events beyond our reasonable control. If you send us feedback or suggestions, we may use them freely without obligation to you. Headings are for convenience only.
